    Ms. Yikai YANG is a counsel of Haiwen & Partners in the Beijing office. Ms. Yang is dedicated to legal service in the field of antitrust and competition in relation to merger control, antitrust administrative investigations, antitrust litigations and antitrust compliance matters.

    Ms. Yang joined Haiwen in 2022, before which she worked at Zhong Lun Law Firm for many years focusing on antitrust and competition law.

    Ms. Yang has experienced expertise in antitrust and competition law and has assisted multinationals, domestic and foreign listed companies, state-owned and private enterprises in domestic and cross-border deals with great significance, to obtain unconditioned approval, and to provide professional opinions regarding transaction layout and transaction agreements.  Ms. Yang has also deeply and extensively involved in the antitrust administrative investigation and litigation cases against various magnate multinational companies regarding monopolistic agreements and abuse of dominance.   Ms. Yang has represented well-known domestic and international leading enterprises in several cases that intersect antitrust and SEP, and has provided comprehensive antitrust compliance legal services to many well-known clients with respect to their business models, compliance self-examination, antitrust compliance mechanism set-up and optimization, etc.  The clients served by Ms. Yang cover dozens of industries, including ICT, semiconductor, TMT, aviation, chemical and materials, pharmaceutical/healthcare, energy and natural resources, etc.

    Represented a large company in the information and communications technology industry in the antitrust administrative investigation, the antitrust litigation and the royalty-rate-setting litigation arising out of multiple SEP disputes with three well-acknowledged multinationals, and assisted in settling part of the disputes thereof;

    Represented a world 500 fortune chemical magnate in response to Chinese Competition Authority’s antitrust investigation of alleged abuse of market dominance and the antitrust litigation thereof;

    Represented a large multinational manufacturing company in response to the investigation initiated by the Chinese Competition Authority regarding the abuse of market dominance;

    Represented a leading Korean-based multinational shipping company in response to the investigation by the Chinese Competition Authority regarding monopoly agreements;

    Represented a pharmaceutical manufacturer in filing a complaint against an API manufacturer regarding its abuse of market dominance;

    Entrusted by the Chinese Competition Authority as the sole monitoring trustee in monitoring the implementation of the restrictive conditions attached to a merger control case in the automotive industry;

    Represented Air China in connection with the merger control notification for its acquisition of shares in Shandong Airlines;

    Represented Danfoss in connection with the merger control notification for its acquisition of shares in Semikron International, Inc.;

    Represented Suez Group in connection with several merger control notifications for its acquisition of shares in several companies;

    Represented Bain Capital, Hillhouse Investment, Temasek, Carrier Group, DNE Group, China Resources, Mengniu Diary, Wanli Group, Shanghai Pharmaceuticals, Zhejiang Artiking, Haohua Tech, Lakala, etc. in connection with merger control notifications for relevant acquisitions of shares;

    Provided antitrust compliance regime set-up and optimization service for a large multinational electrical energy company;

    Provided antitrust compliance regime set-up and optimization service for a large state-owned energy company;

    Provided antitrust compliance review service for a leading pharmaceutical company and assisted in the establishment of its antitrust compliance regime;

    Provided antitrust compliance review service for a large multinational integrated logistics service enterprise and assisted in the establishment and improvement of its antitrust compliance regime;

    Advised a leading Chinese ICT company on antitrust compliance issues for its distribution channel management business.

  • Accolades

    Ms. Yang was awarded by the Legal 500 Asia Pacific as “Next Generation Lawyers” (Antitrust and Competition) in 2018 and in 2019.

  • Education

    Ms. Yang obtained her Bachelor of Laws and Bachelor of Arts in English degree at China University of Political Science and Law, and obtained her Master of Laws degree at Cornell University.

    Ms. Yang is a Chinese native speaker and is fluency in English.
